Talent release questions

What does a talent release form do?

It is the signed permission to film someone and use what you film. It turns "they said it was fine" into something you can show. Use one form per person who can be recognized and whose appearance you mean to use. It says who is filmed and by whom, what is recorded, where it may run and for how long, any payment, and carries their signature and the date. Keep it for as long as you keep or use the footage.

What is the difference between the US and UK versions?

The US version is written around the right of publicity and releases privacy and publicity claims. The UK version gives consent to be filmed and, where what is filmed counts as a performance under the Copyright, Designs and Patents Act 1988 (a scripted read, say), the performer's consent under that Act and a waiver of the performer's moral rights. It also covers UK data protection.

What if the person I am filming is under 18?

A parent or legal guardian signs the form for them. Leave the parent or guardian section on and it prints on the form. In the UK, a child below school-leaving age may also need a performance license from their local council, depending on the kind of shoot and how many days they have performed recently. Check with the council before the day.

Is this legal advice?

No. It is a template and a record, written by a video production company from the form we use on our own shoots. For a campaign, a broadcast commission or anything unusual, have a lawyer read it first.
